Competing Allies: Legal Pluralism, and Gendered Agency in Mumbai’s<i>Sharia</i>Courts

Building upon participant observation in a women’s sharia court Mumbai, run by activists of an Islamic feminist movement India, and its networks with similar alternative dispute resolution forums male qazis (non-state actors trained law Muslim personal law), this article explores the modalities interaction between non-state who adjudicate India. It also delineates how gendered agency is shaped these interactions. This identifies three aspects female actors: (1) everyday cooperation qazi despite their doctrinal differences; (2) gradual assertion through qazi; (3) institutional competition interlaced cooperation. I explore range interactions including contestation collaborative actors, domain that has not been explored existing scholarship on legal pluralism. draw attention to we might think about pluralist context beyond straightforward challenge authority as it forged at intersection individuals, interactions, institutions. Through critical exploration agency, show women both inhabit transform gender norms individual level institutions, expanding pluralism reified “women’s interests.”
